Patient Rights
The following patient rights and responsibilities are provided under Article 4-3 of the Korean Medical Service Act and related legislation.
Patient Rights
1. Right to medical care
Patients have the right to appropriate healthcare to protect and improve their health. Their health-related rights must not be infringed because of sex, age, religion, social status or financial circumstances. Medical professionals may not refuse care without justifiable grounds.
2. Right to information and self-determination
Patients have the right to receive sufficient explanations from their doctor, nurse or other medical professional about their condition, treatment options, participation in medical research, organ transplantation, expected outcomes including side effects, and medical costs. They may ask detailed questions and decide whether to consent.
3. Right to confidentiality
Patients have the right to privacy and confidentiality regarding their body, health and medical care. Medical professionals and institutions may not disclose this information without the patient's consent, except as provided by law, such as for a criminal investigation.
4. Right to seek consultation and mediation
If a dispute relating to medical services arises, patients may seek consultation and mediation from bodies such as the Korea Medical Dispute Mediation and Arbitration Agency.
Patient Responsibilities
1. Trust and respect for medical professionals
Patients should provide accurate information about their health and trust and respect the medical professional's treatment plan.
2. No fraudulent access to care
Patients must identify themselves before receiving care and must not obtain care through false or improper means, such as using another person's identity.
